By using our Services, you are agreeing to the following Terms and Conditions (“Terms” or “Terms and Conditions”).
1. Contractual Relationship
1.1 The following Terms and Conditions govern your access or use of the TravMed Services. For purposes of these Terms, TravMed Services shall commence when You sign up through any digital means made available by TravMed, which includes TravMed’s website(travmed-eg.com), E-mail and social media account(s). These Services include, without limitation, introductions to medical experts in respective medical fields of interest, travel arrangements to Arab Republic of Egypt and any other relevant requests made by You.
1.2 By using TravMed Services, you confirm that You hereby agree to be bound by the following Terms. If you do not agree to these Terms, please refrain from using our Services.
1.3 The Terms and Conditions expressly supersede prior agreements or arrangements made between you and TravMed or any of TravMed’s affiliates. TravMed may, at any time for any reason, terminate these Terms and/or any Services with You, or generally cease offering or denying You access to the Services or any portion thereof.
1.4 TravMed may amend the Terms from time to time. Amendments will be effective upon TravMed's posting of such updated Terms via its website or by E-mail to You(“Supplemental Terms”). Supplemental Terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable Service(s). Supplemental Terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services. Your continued access or use of the Services after such posting confirms Your consent to be bound by the Terms, as amended. If TravMed changes these Terms after the date You first agreed to the Terms (or to any subsequent changes to these Terms), You may reject any such change by providing TravMed a written notice of such rejection within30 days of the date such change became effective, as indicated in the "Effective" date above. This written notice must be provided by email from the email address associated with Your Account. In order to be effective, the notice must include Your full name and clearly indicate your intent to reject changes to these Terms. Unless otherwise indicated, You hereby agree to be bound by the provisions of these Terms as of the date You first agreed to the Terms (or to any subsequent changes to these Terms).
2. Services
TravMed offers two distinct forms of Services; namely Medical Procedure Bookings and Travel Bookings). For purposes of these Terms, Medical Procedure Bookings (also referred to as “Booking”) shall mean any appointment, treatment and/or procedure booked with your assigned Medical Expert in his/her respective medical field of expertise. Travel Bookings shall mean and include, without limitation, flight, hotel, touristic reservations and/or arrangements. Such TravMed Services will together be referred to as “Services” and shall not be distinguished from one another except in this Term and in Term 6 (Payment) and 7(Cancellation Policy).
2-1 Medical Procedure Bookings
a) Services offered to You by TravMed in relation to Medical Procedures are solely to facilitate introductions between You and a well-established renowned Medical Experts in their respective fields. You can choose Services which range from optometry, dentistry, dermatology, to cosmetic procedures.
b) TravMed shall provide You with one (1) consultation, free of charge with the Medical Expert assigned to You. The consultation shall be solely informative.
c) TravMed shall provide You with an offer based on such consultation which shall include Medical Procedure Booking details and any related payment(s) required (“Quotation”).
d) In the event some Services requested require more than one Medical Procedure Booking with the Medical Expert, the Quotation shall make reference to the details of such all such bookings required.
e) Each Quotation shall be confined to the selected Medical Procedure Booking. Where You choose to add any further Bookings, You shall submit a new request and in turn receive a new Quotation thereto by TravMed.
2-2 Travel Bookings
a) TravMed offers tourism and travel packages across Egypt’s cities and destinations. These packages may be inclusive of hotel and flight bookings, sightseeing, excursions and other activities.
b) Flight bookings through TravMed are optional.
c) All Hotel offers shall be 4-stars or higher.
d) The Quotation sent to you by TravMed shall include all requested itinerary dates, locations, prices and down payment.
Any payment(s) required in the Quotation are due to be paid through the payment link provided to You by TravMed. Such payment link shall expire after (76) hours. Once payment is made, TravMed shall send You Your booking confirmation within (48) hours.
3. Access and use of website/Legal Capacity
By using Services, you hereby agree and confirm that you:
- Are at least 18 years of age or above;
- Possess the legal capacity to undergo your chosen medical procedure; and
- Possess the legal capacity to travel for the purpose of your chosen medical procedure whether accompanied or unaccompanied;
- Will use Services in accordance with the Terms and Conditions.
TravMed shall retain the right at its sole discretion to deny access to anyone seeking Services it offers, at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions.
4. Privacy
4.1 TravMed and its affiliates consider the privacy of Your health information a crucial element of our relationship with You. Your personal health information shall remain confidential, private and secure. It is our responsibility to notify You if a breach occurs that may have compromised the privacy or security of Your information.
4.2 For the purpose of this Agreement, Confidential Information shall include but not be limited to all medical, technical, commercial or financial information disclosed by either Party to the other Party or otherwise made accessible, directly or indirectly, to the other Party regardless of the form of disclosure, this Agreement and the provisions thereof and/or all the information disclosed in the course of negotiating and concluding this Agreement (collectively referred to as “Confidential Information”).
4.3 TravMed shall keep the Confidential Information secret and not disclose it to any third party. It shall not use the Confidential Information for any purpose whatsoever except in the manner expressly provided for in this Agreement and for the purpose of this Agreement.
5. Payment
5.1 After submitting Your request to TravMed and after the consultation with the assigned Medical Expert takes place, TravMed shall provide You with a Quotation for the Services requested by You and in accordance with any relevant information arising from the consultation.
5.2 The Medical Procedure Booking You opt for shall be outlined in the Quotation. Should you require having additional Medical Procedure Bookings with Your Medical Expert, these shall be a made in a separate request subject to a new Quotation provided to You by TravMed.
5.3 Each Quotation shall include the payment(s) required for Booking requested by You and any payments required for Travel Bookings as You have requested and delegated TravMed to undertake on your behalf.
5.4 Any such payments required under the Quotation are due to be paid through the payment link (shared to You via E-mail by TravMed). The payment link shall expire after (76) hours. Once payment is made, TravMed shall send You Your booking confirmation within (48) hours.
6. Cancellation Policy
6.1 Where You choose to cancel Your Medical Procedure Booking with Your chosen Medical Expert up to 48-hoursprior to such Booking, You will be charged a fine of 20% of the fee Your original Booking would have cost.
6.2 Where You decide to cancel Your trip altogether up to 48-hour prior to Your scheduled arrival, which You have booked through TravMed, any deposit made shall be non-refundable.
7. Limitation of Liability &Indemnification
8.1 In relation to any claims arising out of or in connection with TravMed’s agreement with you, TravMed’s liability shall be limited solely to the Services provided to You by TravMed.
8.2 Any and all medical procedures offered in association with TravMed’s Services are not the responsibility of TravMed.
8.3 You agree to indemnify and hold TravMed harmless from and against all damages, losses and expenses of any kind (including reasonable lawyer fees and costs) arising out of or related to:
(1) your breach of the Terms and Conditions;
(2) any activity in which you engage on or through TravMed Services; or
(3) your violation of any law or rights of a third party in relation to these Terms and the Services.
8. Governing law
These Terms shall be governed in its execution, interpretation, invalidation and termination by the applicable laws of the Arab Republic of Egypt.
9. Dispute Resolution
Any dispute, controversy or claim arising out of or in connection with this Agreement, the interpretation, execution, termination or invalidation thereof, shall be settled by the competent courts of the Arab Republic of Egypt.
